The Center for Responsible Lending, along with the Consumer Federation of America and National Consumer Law Center, filed an amici curiae on November 7, 2025. The amici are in support of plaintiff Eva Migligore’s request for en banc review at the US Court of Appeals for the Third Circuit to vacate the district court’s ruling to dismiss the case. The case centers on an elderly woman who allegedly signed a $100,000 loan for solar panels. She asserts that she believed the panels were free and that her signature was forged, as she never signed any loan documentation or consented to a credit inquiry. The amici’s key points are:

  • The court erred when it interpreted the FCRA to allow creditors to obtain consumers’ credit information when the consumer has not initiated nor consented to the inquiry. This interpretation is contrary to the plain text and prior court decisions,
  • The court interpreted NJ consumer protection and agency law in a way that removes safeguards from victims of fraud, thereby creating opportunities for consumers to be exploited.
