CRL signed onto an amicus brief supporting NTEU’s request for en banc review at the US Court of Appeals for the DC Circuit. NTEU requests the full court to review a decision that vacates a preliminary injunction in the lower case, which would allow the administration to reduce CFPB’s funding and fire its staff. This is the second amicus brief CRL has signed in this case to support CFPB’s continued work and existence. 

The primary arguments are that 1) CFPB should remain functioning as it performs an essential role in monitoring the consumer financial sector and enforcing federal law, and 2) the court’s decision that CFPB’s actions to dismantle the agency were somehow not yet reviewable is error. CFPB’s actions were in fact a violation of the separation of powers and overstepped Congressional intent.
